Common tax challenges

Agencies have one issue that dominates everything else, and getting it wrong distorts revenue, VAT and Corporate Tax simultaneously.

  • Media spend: agent or principal. If you buy advertising in your own name and recharge the client, that spend is generally your cost and the recharge is your revenue, which means it runs through your books gross. If you act purely as agent, the treatment differs. Agencies that report only their fee while handling large media budgets can materially misstate turnover, which affects the VAT registration threshold as well as the accounts.
  • Overseas ad platforms. Advertising bought from platforms billing from outside the UAE is an imported service and brings the reverse charge. For an agency running meaningful media spend, this is one of the largest reverse charge entries on the return.
  • Retainers and tax point. Monthly retainers billed in advance, project fees billed on milestones and success fees billed on outcome all have different points at which revenue and VAT arise.
  • Freelancers and contractors. Most agencies run on a variable bench. Whether a contractor is VAT registered changes what you can recover, and payments to non-registered individuals need proper documentation to be deductible.
  • Overseas clients. Services to clients outside the UAE may be zero-rated, but only where the conditions are met.
